THIS NOTICE DESCRIBES HOW MEDICAL, BEHAVIORAL HEALTH, AND SUBSTANCE USE DISORDER INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED, HOW YOU CAN ACCESS THIS INFORMATION, AND YOUR RIGHTS REGARDING YOUR HEALTH INFORMATION.
PLEASE REVIEW IT CAREFULLY.
This Notice applies to Believe Detox Center LLC, its workforce members, and health care professionals or other individuals authorized to provide services through the facility.

OUR COMMITMENT TO YOUR PRIVACY
Believe Detox Center LLC is committed to protecting the privacy and security of the personal and health information we create, receive, maintain, or transmit while providing services to you.
This information may include:
- Your name, address, telephone number, email address, and date of birth
- Your medical, behavioral health, and substance use disorder history
- Assessments, diagnoses, treatment plans, progress notes, medications, and discharge information
- Billing, payment, and health insurance information
- Information concerning the services provided to you
- Other information that identifies you or could reasonably be used to identify you
This information is generally referred to as “Protected Health Information” or “PHI.” Substance use disorder patient records may also receive additional protection under federal confidentiality law, including 42 U.S.C. § 290dd-2 and 42 CFR Part 2.
Information that has been properly de-identified and can no longer reasonably be linked to you is not PHI.
OUR LEGAL DUTIES
Believe Detox Center LLC is required by law to:
- Maintain the privacy and security of your PHI and substance use disorder patient records
- Provide you with this Notice describing our legal duties and privacy practices
- Follow the terms of the Notice currently in effect
- Notify you following a breach of unsecured PHI or Part 2 records when notification is required by law
- Provide additional protections for substance use disorder records when required by 42 CFR Part 2
- Comply with applicable federal and California privacy and confidentiality laws
We will not use or disclose your information in a manner that is inconsistent with this Notice unless permitted or required by law.
SUBSTANCE USE DISORDER RECORDS
Federal law provides special confidentiality protections for records that identify an individual as having applied for, received, or been referred for substance use disorder diagnosis, treatment, or referral services from a federally assisted substance use disorder program.
Believe Detox Center LLC will not use or disclose records protected by 42 CFR Part 2 except as permitted by federal law. Depending on the circumstances, your written consent may be required before these records may be used or disclosed.
When permitted by law and supported by a valid written consent, your substance use disorder records may be used or disclosed for treatment, payment, and health care operations. A consent may authorize certain future uses and disclosures for these purposes as permitted by 42 CFR Part 2.
Part 2 records generally may not be used or disclosed in civil, criminal, administrative, or legislative proceedings against you without your specific written consent or a court order and subpoena or other legal mandate that satisfies the requirements of federal law.
A general authorization for the release of medical or other information may not be sufficient to authorize the use or disclosure of Part 2 records in a legal proceeding against you.
A violation of the federal law protecting substance use disorder patient records may be reported to the appropriate authorities in accordance with applicable law.
HOW WE MAY USE AND DISCLOSE YOUR INFORMATION
The following sections describe common circumstances in which Believe Detox Center LLC may use or disclose your PHI. Additional restrictions may apply to substance use disorder records protected by 42 CFR Part 2.
A. Treatment
We may use and disclose your PHI to provide, coordinate, or manage your treatment and related services.
For example, we may share relevant information with authorized physicians, nurses, therapists, counselors, psychologists, pharmacists, laboratories, hospitals, treatment providers, or other health care professionals involved in your care when permitted by law.
When your records are protected by 42 CFR Part 2, we will obtain consent when required before sharing them for treatment purposes.
B. Payment
We may use or disclose your PHI to bill and collect payment for services provided to you.
For example, we may disclose appropriate information to:
- Your health plan or insurance company
- A third-party payer
- A billing company
- A government health benefit program
- Another person responsible for payment
These activities may include eligibility verification, utilization review, prior authorization, claims submission, collection activities, and medical-necessity review.
When Part 2 applies, payment-related disclosures will be made only as permitted by federal law, including pursuant to an appropriate consent when required.
C. Health Care Operations
We may use or disclose your PHI for activities necessary to operate Believe Detox Center LLC and maintain the quality of our services.
Health care operations may include:
- Quality assessment and improvement
- Staff training and supervision
- Credentialing and professional review
- Licensing, certification, and accreditation activities
- Compliance and auditing
- Legal and risk-management services
- Business planning and administration
- Reviewing the qualifications and performance of health care professionals
- Evaluating the effectiveness of our programs and services
When Part 2 applies, we will use or disclose protected records for health care operations only as permitted by federal law.
D. Business Associates and Qualified Service Organizations
We may engage outside individuals or organizations to perform services on our behalf, such as billing, legal, accounting, information technology, records management, quality improvement, or administrative support.
These individuals and organizations may receive PHI only as permitted by law and must appropriately safeguard the information through required agreements.
For services involving records protected by 42 CFR Part 2, we will enter into any additional agreement required by federal law.
E. Appointment Reminders and Communications About Your Care
We may use your contact information to:
- Remind you of appointments
- Discuss scheduling or care coordination
- Provide treatment-related instructions
- Inform you about services, providers, or treatment alternatives that may be relevant to your care
- Contact you regarding follow-up care
You may request that we contact you through a particular method or at an alternative address.
F. Individuals Involved in Your Care or Payment for Your Care
Subject to applicable law and your preferences, we may share limited information with a family member, friend, personal representative, or other person you identify as involved in your care or payment for your care.
When you are available, we may ask for your permission or give you an opportunity to object.
If you are unavailable, incapacitated, or experiencing an emergency, we may disclose limited information when permitted by law and when we determine that the disclosure is in your best interest.
Part 2 records will not be disclosed to family members, friends, or other individuals unless the disclosure is permitted by 42 CFR Part 2.
G. Personal Representatives
We may disclose PHI to an individual legally authorized to act on your behalf, subject to applicable law and appropriate verification of the individual’s authority and identity.
H. Emergencies
We may disclose information when necessary to address a bona fide medical emergency, consistent with HIPAA, 42 CFR Part 2, and other applicable laws.
I. Serious and Imminent Threats
We may use or disclose PHI when we believe in good faith that the disclosure is necessary to prevent or lessen a serious and imminent threat to the health or safety of a person or the public and the disclosure is made to someone reasonably able to prevent or lessen the threat.
Additional restrictions may apply to records protected by 42 CFR Part 2.
J. Public Health Activities
When permitted or required by law, we may disclose PHI for authorized public health activities, such as:
- Reporting certain diseases, injuries, or conditions
- Preventing or controlling disease
- Reporting adverse events or product defects
- Reporting suspected abuse, neglect, or domestic violence
- Complying with legally authorized public health investigations
Part 2 records will be disclosed for public health purposes only when permitted by federal law.
K. Reporting Abuse, Neglect, or Domestic Violence
We may disclose information to an authorized government agency when we reasonably believe an individual is a victim of abuse, neglect, or domestic violence and the disclosure is permitted or required by law.
We will comply with the additional requirements applicable to substance use disorder records.
L. Health Oversight Activities
We may disclose PHI to authorized health oversight agencies for activities such as:
- Audits
- Investigations
- Inspections
- Licensing and certification reviews
- Accreditation
- Disciplinary proceedings
- Compliance reviews
- Government benefit program oversight
Part 2 records will be disclosed for oversight activities only as permitted by applicable federal law.
M. Judicial and Administrative Proceedings
We may disclose PHI in response to a valid court order, subpoena, discovery request, administrative order, or other lawful process when the requirements of HIPAA and applicable state law have been satisfied.
Substance use disorder records protected by 42 CFR Part 2 generally may not be used or disclosed in a legal proceeding against you unless you provide specific written consent or a court order and subpoena or similar legal mandate satisfies the requirements of Part 2.
N. Law Enforcement
We may disclose PHI to law enforcement officials in limited circumstances permitted or required by law.
The disclosure of Part 2 records to law enforcement is subject to heightened restrictions and will occur only when specifically permitted by federal law.
O. Coroners, Medical Examiners, and Funeral Directors
We may disclose PHI to coroners, medical examiners, or funeral directors as authorized by law and as necessary for them to perform their duties.
Additional restrictions may apply to Part 2 records.
P. Workers’ Compensation
We may disclose PHI as authorized by and necessary to comply with workers’ compensation laws or similar programs.
Part 2 records will be disclosed only when permitted by federal law.
Q. Research
We may use or disclose PHI for approved research when the research satisfies applicable privacy, confidentiality, informed-consent, and institutional-review requirements.
Part 2 records will be used or disclosed for research only when the requirements of 42 CFR Part 2 are met.
R. Required by Law
We may use or disclose PHI when required to do so by federal, state, or local law.
When multiple laws apply, we will follow the law providing the greater privacy protection when legally required.
USES AND DISCLOSURES REQUIRING YOUR WRITTEN AUTHORIZATION
Except as otherwise permitted or required by law, Believe Detox Center LLC will obtain your written authorization before:
- Using or disclosing PHI for marketing purposes
- Selling PHI
- Using or disclosing psychotherapy notes, when applicable
- Using or disclosing PHI for purposes not described in this Notice
- Using or disclosing Part 2 records when your consent is required by federal law
We do not sell your PHI.
You may revoke an authorization or consent in writing at any time, except to the extent that we have already acted in reliance on it or as otherwise limited by law.
Revoking an authorization will not affect uses or disclosures already made in reliance on a valid authorization.
FUNDRAISING
Believe Detox Center LLC will not use or disclose your PHI for fundraising communications unless permitted by law.
If we contact you for fundraising purposes, you will have the right to opt out of receiving future fundraising communications.
INCIDENTAL USES AND DISCLOSURES
Certain limited incidental uses or disclosures may occur as a by-product of an otherwise permitted use or disclosure.
We will use reasonable safeguards to limit incidental disclosures and will follow the minimum-necessary standard when that standard applies.
YOUR PRIVACY RIGHTS
You have the following rights regarding your PHI, subject to applicable legal limitations.
A. Right to Inspect and Obtain a Copy
You have the right to inspect and obtain a paper or electronic copy of PHI maintained in a designated record set, including certain medical, clinical, and billing records.
We will respond within the time required by applicable law. When an extension is legally permitted and necessary, we will notify you.
We may charge a reasonable, cost-based fee permitted by law for copying, supplies, postage, or preparation of an agreed-upon summary.
We may deny access to certain information in limited circumstances permitted by law. When applicable, you may have the right to request review of the denial by a licensed health care professional who was not involved in the original decision.
B. Right to Request an Amendment
You may ask us to amend PHI that you believe is incorrect or incomplete.
Your request must be submitted in writing and should explain why you believe the information should be amended.
We may deny the request when permitted by law, including when:
- The information was not created by Believe Detox Center LLC
- The information is not part of the records we maintain
- The information is not available for inspection
- We determine that the information is accurate and complete
If we deny your request, we will provide a written explanation and information about your right to submit a written statement of disagreement.
C. Right to an Accounting of Disclosures
You may request a list of certain disclosures of your PHI made during the period permitted by law before the date of your request.
The accounting will not include disclosures that applicable law excludes from the accounting requirement.
You may also have the right to receive an accounting of certain disclosures of Part 2 records for treatment, payment, and health care operations when required by federal law.
One accounting within a 12-month period will generally be provided without charge. We may charge a reasonable, cost-based fee for additional requests during the same period after informing you of the anticipated fee.
D. Right to Request Restrictions
You may request restrictions on certain uses or disclosures of your PHI for treatment, payment, or health care operations.
We are generally not required to agree to a requested restriction unless otherwise required by law.
When you pay for a health care item or service in full, out of pocket, you may ask us not to disclose information about that item or service to your health plan for payment or health care operations. We will honor that request unless the disclosure is required by law.
You may also request restrictions on disclosures to family members, friends, or others involved in your care.
E. Right to Request Confidential Communications
You may request that we communicate with you through a particular method or at a particular location.
For example, you may request that we contact you only at a specific telephone number, email address, or mailing address.
We will accommodate reasonable requests. We will not require you to explain the reason for the request.
F. Right to Revoke an Authorization or Consent
You may revoke a written authorization or Part 2 consent by submitting a written revocation to Believe Detox Center LLC.
The revocation will not affect actions already taken in reliance on the authorization or consent.
G. Right to Receive Notice of a Breach
You have the right to be notified following a breach of unsecured PHI or Part 2 records when notification is required by law.
H. Right to Receive a Paper or Electronic Copy of This Notice
You may request a paper copy of this Notice at any time, even if you previously agreed to receive it electronically.
An electronic copy may also be made available on our website, if applicable.
I. Right to Choose a Personal Representative
You may authorize another person to exercise your privacy rights and make decisions about your health information.
Before recognizing that person as your personal representative, we may require documentation establishing their legal authority.
J. Right to File a Complaint Without Retaliation
You may file a complaint if you believe your privacy or confidentiality rights have been violated.
Believe Detox Center LLC will not intimidate, threaten, coerce, discriminate against, or retaliate against you for:
- Filing a complaint
- Participating in an investigation
- Exercising a privacy right
- Refusing to authorize a use or disclosure not otherwise permitted by law

CHANGES TO THIS NOTICE
Believe Detox Center LLC reserves the right to change the terms of this Notice and its privacy practices as permitted by law.
A revised Notice may apply to all PHI and Part 2 records maintained by Believe Detox Center LLC, including information created or received before the effective date of the revised Notice.
When we make a material change, we will promptly revise the Notice and make the updated version available:
- At the facility
- Upon request
- On our website, if applicable
- Through any other method required by law
